1. Who provides the finance

All credit and financing displayed on the Website under the Buy Now, Pay Later, “Finance.gi” or instalment options is provided solely by Horizon Finance Limited, a company incorporated in Gibraltar  trading as Finance.gi, whose registered office is at Unit 16, Honeysuckle House, Waterport Terraces Gibraltar (“the Lender”, “Horizon Finance”, “we”, “us”). Horizon Finance Limited is authorised and regulated by the Gibraltar Financial Services Commission (GFSC)Music Corner LTD is a retailer of goods and is not the lender. Music Corner does not provide credit, does not make lending decisions, and does not give financial or credit advice. Music Corner’s role is limited to displaying the price of goods and an illustrative BNPL example, and to introducing customers who wish to apply for finance to Horizon Finance Limited.

2. The representative example

Any BNPL price shown on the Website is a representative example only and is provided for illustration. It is not an offer of credit and does not guarantee the rate, term or monthly payment that any individual customer will be offered. The actual terms offered to you will depend on the outcome of Horizon Finance’s assessment (see section 4).

Illustrative example, based on a 12-month term:

• Cash price of goods: £1,000.00
• Total charge for credit: £250.00 (a flat charge of 25% of the amount financed over the 12-month term)
• Total amount payable: £1,250.00
• Term: 12 monthly instalments
• Monthly instalment: £104.17

Representative APR: 53.3%The representative example assumes no deposit, equal monthly instalments, and prompt payment. Rounding may cause the final instalment to differ by a few pence.

3. Eligibility

To apply for BNPL finance you must:

• be at least 18 years of age;
• be a resident of Gibraltar (or such other jurisdiction as Horizon Finance may permit) with a verifiable address;
• have a valid form of identification and pass identity, sanctions and anti-money-laundering checks;
• hold a bank account in your name capable of accepting a Direct Debit or other approved payment method; and
• provide accurate, complete and truthful information in support of your application.

4. Application, credit assessment and approval

All finance applications are made to, assessed by, and approved or declined solely by Horizon Finance Limited. Approval is subject to identity verification, affordability and creditworthiness assessment, and any other checks Horizon Finance considers appropriate. Horizon Finance may approve or decline any application at its discretion and is not obliged to give reasons. Music Corner has no involvement in, and no influence over, any lending decision. Where an application is declined, no credit agreement is formed and the goods remain available for purchase by other payment methods offered by Music Corner.
If your application is approved, a separate credit agreement between you and Horizon Finance Limited will govern the finance. That credit agreement, and not these Terms, sets out your binding obligations as borrower, including the rate, charges, instalment amounts, payment dates and your statutory rights.

5. Relationship between these Terms and the credit agreement

These Terms govern the display and promotion of BNPL on the Website only. In the event of any conflict between these Terms and the signed credit agreement issued by Horizon Finance, the credit agreement prevails in respect of the finance.

6. The goods

The contract for the sale of the goods is between you and Music Corner. Music Corner is responsible for the goods, including their description, quality, availability, delivery, and any warranty, returns or after-sales matters, in accordance with Music Corner’s own sale terms and applicable consumer law.
Horizon Finance is responsible only for the provision of credit and is not the supplier of the goods. Nothing in these Terms affects any statutory rights you may have against the supplier, or any connected-lender liability that may arise under applicable Gibraltar consumer-credit law.

7. Payments, arrears and default

Where finance is approved, you must make each monthly instalment in full and on time in accordance with your credit agreement with Horizon Finance. Missing payments may result in additional charges, may affect your credit standing, and may lead Horizon Finance to pursue recovery of the outstanding balance, including through its collections process and, where necessary, legal action. Full details of charges and consequences of non-payment are set out in your credit agreement and pre-contract information.

8. Right of withdrawal / cancellation

Your statutory right to withdraw from or cancel the credit agreement (and any applicable cooling-off period) is set out in the credit agreement and pre-contract documentation provided by Horizon Finance.

9. Data protection

When you apply for finance, Horizon Finance Limited acts as data controller in respect of the personal data it collects to assess and administer your application, including identity, affordability, credit-reference, sanctions and fraud-prevention checks. Music Corner acts as data controller for the personal data it collects for the sale of goods. Each party processes personal data in accordance with the Gibraltar data-protection regime and its own privacy notice. 10. Intellectual property and branding

“Finance.gi” and related names, logos and marks belong to Horizon Finance Limited. “Music Corner” and related marks belong to Music Corner. Neither party acquires rights in the other’s marks except as needed to display the BNPL option on the Website in the agreed form.

11. Liability

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded. Subject to that, Music Corner is not liable for the acts or omissions of Horizon Finance in connection with the finance, and Horizon Finance is not liable for the goods or for Music Corner’s acts or omissions in connection with their sale. Each party remains responsible for its own regulatory obligations.

12. Complaints

Complaints about the goods should be directed to Music Corner directly at sales@musiccorner.gi. Complaints about the finance, the credit agreement or any lending decision should be directed to Horizon Finance Limited at +350 225 03017 or by emailing finance@finance.gi. Horizon Finance operates a complaints procedure in accordance with GFSC requirements, details of which are available on request.

13. Changes to these Terms

These Terms may be updated from time to time. The version displayed on the Website at the time you apply is the version that applies to your application.

14. Governing law and jurisdiction

These Terms, and any credit agreement entered into with Horizon Finance Limited, are governed by the laws of Gibraltar, and the courts of Gibraltar have exclusive jurisdiction over any dispute arising from them.
